I love how the Justice Department is releasing this report without any media attention because the media is too busy talking about Obama’s State of the Union address, or Obama’s Republican beat down, or Obama’s college basketball play-by-play, or Obama’s budget proposal:

Bush administration lawyers who paved the way for sleep deprivation and waterboarding of terrorism suspects exercised poor judgment but will not be referred to authorities for possible sanctions, according to a forthcoming ethics report, a legal source confirmed.

The work of John C. Yoo and Jay S. Bybee, officials in the Bush Justice Department’s Office of Legal Counsel, provided the basis for controversial interrogation strategies that critics likened to torture in the years after al-Qaeda’s 2001 terrorist strikes on American soil. The men and their OLC colleague, Steven G. Bradbury, became focal points of anger from Senate Democrats and civil liberties groups because their memos essentially insulated CIA interrogators and contractors from legal consequences for their roles in harsh questioning.

The reasoning, set out in a series of secret memos only months after Sept. 11, 2001, prompted a multi-year investigation by the department’s Office of Professional Responsibility, which reviews the ethics of Justice lawyers. The legal source was not authorized to discuss the report’s conclusions and described them on the condition of anonymity.

This is a fucking amazing political move from a department that’s supposed to be apolitical. And this means that not only has the Bush administration legalized torture, but they’ve politicized the Department of Justice.

Which means justice is blind only when your party is in power.

    It’s always been political. It’s just that it is getting more up front and in your face.

    OK, My transfer from USAO-DC to DoJ Civil. was due to the person I was working with feeling “threatened”. I’m not sure why since I was a CACI contractor, which meant that I had a job title of paralegal yet was doing attorney work. In fact, I was overqualified as a paralegal, but DoJ (and other agencies) could use the contractor game to their own benefit. And, there was no chance DoJ would hire me, since they didn’t hire their own paralegals who became attorneys.

    Still, I was seen as being the person “in charge” of the project.

    So, I spent the next year or so at the Savings and Loan litigations that consisted of moving boxes and playing hover on the computer before deciding to cut out on my own.

    One look at your blog and its “I’m highly smart; don’t talk to me unless you are as smart as I am” shows that you are unsure of yourself in many ways, and you pepper your misguided ideas with made-up facts about your life.

    There’s reasons most people can pick up on other people’s general untruths and personal agendas, even in text – and they don’t need psychology majors to discern them.

    Yep! The Contractors were given the scutwork and none of the glory.

    BTW, although I was paid by CACI, my direct boss was Eric Holder. That added to the friction of the AUSA co-worker. Most people saw me as the head of the project rather than him: again amusing since I was a contractor.

    For our friend, it’s a bit like saying that the Abu Gharab thing wasn’t DoD employees, but CACI contractors.

    CACI likes to keep a low profile, but they are bigger than XE/Blackwater. Also, they like to pretend they are civilian, but they are primarily Military and Intelligence. I can’t complain though since they treated me pretty well: other than ending up at the savings and loan litigations.

    Still, a lot of other employers would have fired me for less.

    (And I have a photocopy of my USAO ID).
